    1. WELCOME

    Welcome to KiddoStars ("Application").

    This Privacy Policy ("Policy") for Smplfy OÜ ("Company", "we", "us" or "our") describes what personal information we collect, how and why we might access, collect, store, use and/or share ("Process") it when you use our Application, including when you:

    • download and use our Application or any other application of ours that links to this Policy;
    • engage with us in other related ways.

    Your agreement ("Agreement") with us includes this Policy and Terms of Use. By using our Application, you acknowledge that you have read and understood the Agreement, and agree to be bound by it.

    If you do not agree with (or cannot comply with) the Agreement, then you may not use the Application, but please let us know about that by any means stated in Clause 22 of this Policy.

    2. DEFINED TERMS

    "Data Controller" refers to individual or legal person whom Personal Data is provided to, including third party. For the purpose of this Policy, we are a Data Controller of your Personal Data;

    "Data Processors" (or "Service Providers") refers to any individual or legal person whom the right to Process the Personal Data is provided to by the data owner or by the law. We may use third parties in order to process data more effectively;

    "Data Subject" refers to any identifiable individual whose Personal Data is Processed;

    The Application acquires the information you supply when you download and register the Application.

    Registration with us is not mandatory. However, bear in mind that you might not be able to utilize some of the features offered by the Application unless you register with them.

    We may also use the information you provided to contact you from time to time to provide you with important information, required notices and marketing promotions (if any).

    In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

    4. TYPES OF DATA COLLECTED

    Personal Data

    The Personal Data that we collect depends on the context of your interactions with us and the Application, the choices you make, and the Services and features you use. The Personal Data we collect may include:

    • First Name and Last Name;
    • Username;
    • Email Address;
    • Debit/credit card numbers;
    • Billing Address;
    • Cookies and Usage Data.

    Sensitive Information

    We do not Process sensitive information.

    Payment Data

    We may collect the data necessary to process the payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument.

    Mobile Device Data

    We automatically collect device information (such as, your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server).

    Geolocation Information

    We may request access or permission to track your location-based information from your mobile device, either continuously or while you are using our Application.

    If you wish to change our access or permissions, you may do so in your device's settings.

    Cookies

    We may use Cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Application. Some online tracking technologies help us to maintain the security of our Services, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

    You can opt out of online tracking technologies by submitting a request to us by any means stated in Clause 22 of this Policy.

    5. DATA USAGE

    We will use the information collected in our legitimate interests, where we have considered these are not overridden by your rights:

    • to administer our Application and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
    • to keep our Application safe and secure;
    • for measuring or understanding the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you;
    • to improve our Application to ensure that content is presented in the most effective manner for you and for your device;
    • to allow you to participate in interactive features of our Application and Services, when you choose to do so;
    • to deliver and improve our products and services and your overall user experience.

    6. DATA RETENTION

    We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter.

    We will retain Mobile Device Data for up to 24 months and thereafter may store it in aggregate. If you'd like us to delete the data that you have provided via the Application, please contact us by any means stated in Clause 22 of this Policy and we will respond in a reasonable time.

    7. TRANSFER AND DISCLOSURE OF DATA

    Only aggregated, anonymized data is periodically transmitted to external services to aid us in improving the Application and our Service. We may share your information with third parties in the ways that are described in this Policy.

    8. SECURITY

    We are concerned about safeguarding the confidentiality of your information. We have implemented appropriate and reasonable technical and organizational security measures designed to protect security of any personal information we Process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure.

    9. ARTIFICIAL INTELLIGENCE

    As part of our Application, we offer features or tools powered by artificial intelligence, machine learning, or similar technologies. These features and tools are designed to enhance your experience and provide you with innovative solutions. All personal information processed using artificial intelligence, machine learning, or similar technologies is handled in the line with this Policy and our agreement(s) with third parties.

    10. YOUR RIGHTS UNDER GDPR

    If you are a resident of the European Union (EU) and European Economic Area (EEA), you have certain data protection rights and guarantees, covered by GDPR. The Company guarantees you the following data protection rights:

    • the right to request and receive all the information we have about you;
    • the right to request to delete the information;
    • the right of rectification;
    • the right to object;
    • the right to stop and restrict;
    • the right to data portability;
    • the right to withdraw consent.

    11. YOUR RIGHTS UNDER CALOPPA

    In accordance with the CPPA, we agree to the following:

    • users can visit our Application anonymously;
    • our link to this Policy contains the word "Privacy" and can be easily found on the home page of our Service;
    • users will be notified of any changes to this data handling policy on our page with the text of this Policy;
    • users can change their personal information by sending us an email to our email address.

    12. YOUR RIGHTS UNDER CCPA

    If your place of registration is in California, you have the right to know what data we collect about you, to request the deletion of your data and not to sell (transfer) it.

    13. THIRD PARTIES

    We may hire third-party companies and individuals to support our Service ("Service Providers"), provide the Service on our behalf, provide services related to the Service, or assist us in analyzing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

    14. ANALYTICS

    We may use third-party Service Providers to monitor and analyze the use of our Service.

    15. BEHAVIORAL REMARKETING

    We use remarketing services to advertise our Service on third party websites after you visited our Service.

    16. PAYMENT SERVICE PROVIDERS

    We may provide paid products and/or services as part of the Service. In this case, we use third-party services to process payments (for example, payment service providers). We do not store or collect your payment card data.

    Payment service provider we work with: Paddle (privacy policy). Paddle acts as Merchant of Record and processes all transactions, including taxes and refunds.

    17. LINKS TO OTHER SITES

    Our Service may contain links to third party web sites that are not controlled by us. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party web sites.

    18. MINOR'S PRIVACY

    We do not use the Application to knowingly solicit data from or market to children under the age of 13. We encourage parents and legal guardians to monitor their children's Internet usage.

    19. OPT-OUT RIGHTS

    You can halt all collection of information by the Application easily by uninstalling the Application.

    20. CHANGES

    This Policy may be updated from time to time for any reason. You are advised to consult this Policy regularly for any changes, as continued use is deemed approval of all changes.

    21. CONSENT

    By using the Application, you are giving your consent to us processing of your information as set forth in this Policy now and as amended by us.
